1章 はじめに
本製品の使用許諾契約書は下記の通りです。
フレームワークスソフトウェア使用許諾契約書
株式会社フレームワークスソフトウェア(以下,フレームワークスという)は,お
客様に対し,本契約の条件に従い,このソフトウェアおよびドキュメントを使用す
る非独占的権利を許諾します.
【使用許諾】
1.お客様は,このソフトウェア(マニュアルその他本製品の関連ドキュメントを
含む)を単一のコンピュータ上でかつパッケージに記載の利用制限範囲内で使用す
る権利を有します.お客様は自己の業務を処理するためのみにこのソフトウェアを
使用することができます.
2.お客様は,以下にあげる行為をしてはいけません.
(a) このソフトウェアの製品表示,著作権表示またはその他の注意書,制限事項を
抹消すること.
(b) このソフトウェアを第三者に対して再使用許諾,貸与,移転,販売,譲渡公衆
送信(送信可能化含む)およびその他の処分をなすこと.
(c) このソフトウェアを使用してASP(ホスティングサービス含む)などの業務を
行うこと.(ASPサービスに利用する場合には別途にライセンスが必要になり
ますので,フレームワークスまたは販売店にご相談ください)
(d) このソフトウェアをリバース・エンジニアリング,逆アッセンブル,逆コンパ
イルしたり,またそれらの行為を第三者に行わせること.
【契約の解除】
お客様が本契約の許諾条項のいずれかに違反した場合には,フレームワークスから
通知すること無く直ちに本契約は終了します.その場合,お客様はこのソフトウェ
ア,ドキュメントおよびそれらの複製物すべてを破棄しなければなりません.
【保証】
1.フレームワークスはこのソフトウェアが記録された媒体に関し,このパッケージ
が引き渡された日から30日以内にお客様より返却された物理的な不具合のある媒体
の交換をいたします.ただし,事故,乱用,誤用により生じた場合の交換の責任は
負いません.
2.このソフトウェアおよびドキュメントは,現状有姿で提供され,商品性,特定目
的の適合性を含む,明示,黙示を問わず,いかなる保証もないものとします.また
このソフトウェアがお客様の要求に合致すること,動作が中断しないこと,エラー
のないこと,エラーやソフトウェアの不具合が完全に是正されることについても保
証しません.
【責任の制限】
1.フレームワークスおよび代理店のいずれも,契約上の行為か不法行為による損害
かを問わず,このソフトウェアの使用または使用不能から生じた偶発的,特別,間
接損害(逸失利益,業務の中断,データの損失を含む)その他一切の損害に関して,
たとえかかる損害発生の可能性について知らされていた場合でも,お客様ないし第
三者が蒙った損害に対し,なんら責任を負わないものとします.
2.前項にかかわらず,いかなる場合も,フレームワークスに責任がある場合のお客
様への賠償は,フレームワークスの本契約の履行または不履行の直接的結果として
現実に発生した通常の損害についてのみとし,かつ金50,000円を超えないものとし
ます.
【守秘義務】
お客様は、このソフトウェアの内容(マニュアルその他関連ドキュメントの内容含
む)およびこのソフトウェアの使用に関連して知り得た一切の技術情報(サポート
情報含む)を第三者に開示・漏洩してはならないものとします.
【輸出規制】
お客様はこのソフトウェア,関連する技術データ,その直接的製品を,直接,間接
を問わず,日本国の法律・規制に違反して輸出してはいけません.また,日本国以
外で合法的に入手されたお客様の場合は,日本法・規制・もしくは入手場所に摘要
される法律・規制により許可されている場合を除き,このソフトウェア,関連技術
データ,その直接的製品を再輸出しないことに同意するものとします.
【その他】
1.本契約は,日本国法に準拠するものとします.また,本契約により生じる紛争は,
東京地方裁判所を専属的管轄裁判所とします.
2.フレームワークスは,このソフトウェアに関し,お客様の使用状況を監査できる
ものとします.
3.このソフトウェアには,第三者のソフトウェアおよびその他の著作物が含まれて
います.それら著作物については当該第三者が定める各条項が適用されるものと
します.
4.お客様がアメリカ合衆国政府関係者である場合には,このソフトウェアは、商業
用コンピュータ・ソフトウェア及び商業用コンピュータ・ソフトウェア文書とし
て、その使用・複製・開示は、FAR第12.212節またはDFARS第227.7202-3節に
従い、本使用許諾契約の条項が適用されます.
本製品の使用許諾契約書は下記の通りです。
フレームワークスソフトウェア使用許諾契約書
株式会社フレームワークスソフトウェア(以下,フレームワークスという)は,お
客様に対し,本契約の条件に従い,このソフトウェアおよびドキュメントを使用す
る非独占的権利を許諾します.
【旧版の使用権等】
このソフトウェアはアップグレード版につき,このアップグレード版はお客様が正
規に購入され使用許諾を受けている旧版がインストールされているコンピュータに
のみインストールして使用することができます.
また、次にあげる場合を除き,アップグレード版のインストール後は,お客様の旧
版の使用権は消滅するものとします.
・アップグレード版の動作検証の為の一定期間(30日間)併用する場合
・前記検証の結果、旧版の継続使用を選択し、すみやかにアップグレード版を廃棄
して、旧版のみを使用する場合
【使用許諾】
1.お客様は,このソフトウェア(マニュアルその他本製品の関連ドキュメントを
含む)を単一のコンピュータ上でかつパッケージに記載の利用制限範囲内で使用す
る権利を有します.お客様は自己の業務を処理するためのみにこのソフトウェアを
使用することができます.

WebRelease には Apache Software Foundation の Tomcat が同梱されています。WebRelease をインストールすると Tomcat は ~wr2/ThirdPartyProducts/tomcat 以下に配置されます。この Tomcat 部分については Apache License, Version 2.0 が適用されます。この Tomcat は Apache Software Foundation から配布されているものと同一であり FrameWorks Software, Inc. によるコードやドキュメンテーションの修正はありません。
WebRelease には Amazon Inc 製の JDK Corretto が同梱されています。WebRelease をインストールすると Corretto は ~wr2/ThirdPartyProducts/jdk 以下に配置されます。Corretto については、以下のライセンスが適用されます。
